1. Introduction
Welcome to Rogue Artwork & Photography, also affiliated and doing business as Montgomery Media LLC. These Terms of Service govern your use of our website and services, including the purchase of photography and video packages, prints, and related products. By accessing or using our services, you agree to comply with these Terms.
2. Services Offered
We provide professional photography and videography services, including but not limited to:
Custom photo and video packages for weddings, events, portraits, and commercial use
Digital and physical print sales
Editing and retouching services
Event expansions and collaborations with third-party vendors
3. Booking and Payments
A 50% retainer is required to secure your booking, which is non-refundable unless otherwise stated.
Full payment must be made prior to on the date of event. Unless personal arrangements have been made to the client and photographers satisfaction. Under all circumstances, final payment is due prior to the release of any and all final photos or videos.
Payments are processed securely through third-party providers (e.g. Stripe, Venmo, Cashapp, Cash) and we do not store your payment details.
Cancellations must be made at least 90 days before the scheduled session to receive a partial refund.
4. Copyright and Usage Rights
All photographs and videos are the intellectual property of Rogue Artwork & Photography unless otherwise agreed upon in writing.
Clients are granted a non-exclusive license to use the delivered media for personal or commercial purposes based on the package purchased.
Unauthorized reproduction, resale, or MODIFICATION of our work is strictly prohibited.
5. Delivery and Turnaround Time
Standard delivery time for edited images is outlined in your contract and based up your package size.
Video projects may take up to 12 weeks for final delivery.
Rush delivery options may be available for an additional fee.
6. Client Responsibilities
Clients must provide accurate details when booking and ensure all necessary permissions are obtained for locations and subjects involved in the shoot. As well as keep clear and open communication during the planning and editing process.
We are not responsible for delays or issues caused by client unavailability or unpreparedness during scheduled sessions.
7. Refunds and Reshoots
Refunds are not available for completed work. Retainers will be liquidation into hours spent on planning and costs accrued before the scheduled event. Reshoots may be offered at our discretion.
In the event of technical failure or unforeseen circumstances on our end, we will offer a reshoot or partial refund.
8. Limitation of Liability
We are not liable for any indirect, incidental, or consequential damages resulting from the use of our services.
Our liability is limited to the amount paid by the client for the specific service provided.
9. Privacy and Data Protection
Personal information collected for bookings and transactions is handled per our Privacy Policy.
We do not share client data with third parties except as necessary to fulfill services.
10. Changes to Terms
We reserve the right to update these Terms at any time. Clients will be notified of significant changes.
